RE: The tariff classification of ladies’ pullovers from China

Dear Mr. Bonvissuto:

In your letter dated June 13, 2006, written on behalf of Joyce Leslie, you requested a classification ruling.

Submitted styles 7013/15/16, 7028, and 7030, scoop-necked, v-necked, and turtle-necked, respectively, are long-sleeved garments, manufactured from rib-knitted fabric of 80% cotton/18% nylon/2% spandex. All of the components of all of the garments are knit to shape and assembled by linking and looping.

As you have requested, the sample garments and their accompanying component parts are being returned.

The applicable subheading for the three styles will be 6110.20.2077, Harmonized Tariff Schedule of the United States (HTSUS), which provides for pulloversknittedof cotton, other, other, other, women’s, knit to shape articles described in statistical note 6 to this chapter. The duty rate will be 16.5 per cent ad valorem.

The pullovers fall within textile category designation 339. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
