RE: The tariff classification of an outerwear jacket from Macau and China

Dear Ms. Stubblefield:

In your letter dated June 8, 2006, you requested a classification ruling.

The sample submitted, style number 3101 “Nylon Coach’s Jacket-Lined,” is a boy’s hip-length windbreaker-type jacket constructed of a shell composed of a woven 100% nylon fabric that has a polyurethane coating. The garment is lined with a knit polyester tricot fabric. The boy’s jacket will be imported in sizes XS to L. The same jacket will also be imported under style number 3100 in men’s sizes S to 5XL.

The coating is not visible as that term is defined in the tariff, therefore HTS 6210 does not apply.

The jacket has a full front opening secured by a left-over-right, five-snap closure, a fold-down pointed collar, long sleeves with elasticized cuffs, two front slash pockets at the waist and a drawcord tightening through the bottom hem.

The sample is being returned to you.

This garment is eligible for classification as water resistant. If styles 3100 and 3101 pass the water resistance test specified in the Harmonized Tariff Schedule of the United States (HTSUS), Chapter 62, U.S. Note 2, then the applicable HTS subheading for the garment will be 6201.93.3000, which provides for other men's or boys’ anoraks, windbreakers and similar articles of man-made fibers, water resistant. The duty rate will be 7.1 percent ad valorem.

If style 3100 does not pass the water resistance test, then the applicable HTS subheading for the garment will be 6201.93.3511, which provides for other men's anoraks, windbreakers and similar articles of man-made fibers. The duty rate will be 27.7 percent ad valorem.

If style 3101 does not pass the water resistance test, then the applicable HTS subheading for the garment will be 6201.93.3521, which provides for other boys’ anoraks, windbreakers and similar articles of man-made fibers. The duty rate will be 27.7 percent ad valorem.

Both styles 3100 and 3101 fall within textile category designation 634. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
