RE: The tariff classification of a woman’s jacket from China

Dear Ms. Shira:

In your letter dated May 22, 2006, you requested a tariff classification ruling on behalf of Polo Ralph Lauren Corporation. The submitted sample will be returned to you as requested.

Style S0640L13M is a woman’s jacket composed of knit and woven components. The back panel, sleeves and collar are constructed from 100 percent cotton knit fabric. The front panels are constructed from 100 percent woven polyester fabric. The jacket features long sleeves with elbow pads, a stand up collar, two pockets with snap closures at the waist and a full front zippered opening. The essential character of the garment is imparted by the polyester woven fabric which forms the entire front of the garment.

The applicable subheading for the jacket will be 6211.43.0078, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of man-made fibers: jackets and jacket-type garments excluded from heading 6202. The duty rate will be 16 percent ad valorem.
