RE: The tariff classification of maternity pullovers from China

Dear Ms. Stecklair

In your letter dated May 19, 2006 you requested a classification ruling.

The submitted garments are long-sleeved, v-necked garments, manufactured from knitted fabric, style 93197 of 80% cotton/20% nylon and style 18298 of 84% rayon/16% nylon.

As you have requested, the sample garments and their accompanying component parts are being returned.

Because there are no lines of demarcation on the garments nor contouring, the applicable subheading for style 93197 will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for pullovers knitted, of cotton, other, other, other, women’s, other; and for style 18298 will be 6110.30.3059, HTSUS, which provides for pulloversknittedof man-made fibers, other, other, other, other, other, women’s, other. The duty rates will be 16.5 and 32 per cent ad valorem, respectively.

Style 93197 falls within textile category designation 339 and the other style within 639. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
