RE: The tariff classification of a decorative glass article from China

Dear Ms. VanDeusen:

In your letter dated May 16, 2006, on behalf of your client, Lamrite West Inc., you requested a tariff classification ruling. A representative sample was submitted and will be returned to you as requested.

The submitted sample, item number CC067, is a multi-faceted, decorative glass article in the form of a heart-shaped diamond. The item is composed of clear glass. The measurements are approximately 3 inches in height by 31/2 inches in width.

You stated in your letter that this article will be sold as a party favor for wedding/bridal showers. In your letter you suggest classification under subheading 9505.90.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for confetti, paper spirals or streamers, party favors and noisemakers: parts and accessories thereof. This product, however, is not a party favor; it is not limited or associated with any specific festive occasion.

 You stated in your letter that the unit value of this article is over thirty cents but not over three dollars.

The applicable subheading for the decorative glass article will be 7013.99.5000, HTSUS, which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposesother glassware: other: other: other: valued over $0.30 but not over $3.00. The rate of duty will be 30 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
