RE: The tariff classification of a cardigan for ladies’ wear from China

Dear Mr. Leung:

In your letter dated May 11, 2006 you requested a classification ruling.

Submitted style B60608/CB6209, manufactured from knitted fabric of 100% cotton, is a long-sleeved, collared, zippered-front garment.

Because the zippered placket of this garment is not knit to length, but is cut into two pieces, the applicable subheading for this style will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweatersand similar articles, knittedof cotton, other, other, other, women’s, other. The duty rate will be 16.5 per cent ad valorem.

The cardigan falls within textile category designation 339. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
