RE: The tariff classification of quartz digital wrist watch from China

Dear Ms. De Silva:

In your letter dated April 6, 2006, you requested a tariff classification ruling on a quartz digital wrist watch imported from China. A sample of the Dora the Explorer Days of the Week Watch was submitted with the ruling request.

Item number PP 352761, the Dora the Explorer Days of the Week Watch, is designed to encourage a child to learn the days of the week. The watch contains a battery operated electronic watch movement with a liquid crystal display (LCD) that features the hour and minutes. The face of the watch has a picture of Dora the Explorer. The watch has a round palladium cobalt plated (PCP) silver tone zinc alloy case with a stainless steel back and a plastic strap decorated with pink and purple flowers. It includes seven interchangeable colored double-sided plastic tabs approximately 1 inch in length by ΒΌ inch in width on which the names of the days of the week are printed. The days of the week are printed in English on one side, and in Spanish on the other side. The strap has two small metal posts on which to fasten the day of the week tab. You have indicated in your letter that the watch contains a movement that is made in Japan.

Your sample is being returned as requested.

The applicable subheading for the wrist watch will be 9102.12.80, Harmonized Tariff Schedule of the United States (HTSUS), which provides for wrist watches, pocket watches and other watches, including stop watches, other than those of heading 9101: wrist watches, electrically operated, whether or not incorporating a stop watch facility: with opto-electronic display only: other. The rate of duty will be free.

The applicable subheading for the plastic watch strap will be 9102.12.40, HTSUS, which provides for straps, bands or bracelets entered with watches of subheading 9102.12.80 and classifiable therewith pursuant to additional U.S. note 2 to this chapter: all the foregoing whether or not attached to such watches at the time of entry: other. The rate of duty will be free.
