RE: The tariff classification of dyed 100% polyester weft knit fabric from China.

Dear Mr. Iwaki:

In your letter dated May 2, 2006, on behalf of your client Toyota Boshoku America, Inc., you requested a classification ruling.

The submitted sample, designated as style “NO LAMINATED VECTOR”, is a dyed weft knit fabric composed of 100% polyester. It is characterized by textured surface and features a double knit or interlock construction. Weighing 370 g/m2, this product will be imported in 168 centimeter widths. Your correspondence indicates that this fabric will be used as a furnishing fabric on the interior of an automobile.

The applicable subheading for the weft knit fabric will be 6006.32.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other knitted or crocheted fabrics, of synthetic fibers, dyed, of double knit or interlock construction, of polyester. The duty rate will be 10 percent ad valorem.

This fabric falls within textile category designation 222. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
