RE: The tariff classification of a woman’s knit top from Macau.

Dear Ms. De Silva:

In your letter dated March 30, 2006, you requested a classification ruling for a woman’s knit top.

The submitted sample, Style #PP349169, is a woman’s top constructed form 100% cotton knit fabric. The sleeveless garment features a modified V-shaped neckline in front with lace trim, elasticized adjustable shoulder straps, and a hemmed bottom. The bust area is constructed from 85% nylon and 15% spandex knit fabric, and decorated with beads and spangles. The upper back extends straight across from side seam to side seam.

We are returning your sample as you requested.

The applicable subheading for the top, Style PP349169, will be 6114.20.0010 Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, knitted or crocheted of cotton, tops, women’s or girls’. The rate of duty will be 10.8% ad valorem.
