RE: The tariff classification of a woman’s pullover from China

Dear Ms. Tab:

In your letter dated March 11, 2006, you requested a classification ruling.

The submitted sample, style number 210204, is a woman’s one-piece layered look pullover that simulates a cropped garment worn over a pullover. The garment is constructed from 74% rayon, 26% nylon knit fabric. The outer surface of the garment measures more than 9 stitches but equal to or less than 18 stitches per 2 centimeters in the direction that the stitches were formed. The pullover features a scoop neckline. The cropped portion has criss-cross front panels forming a V-neckline and ties from back to front. The garment also features long sleeves with ribbed edges and a ribbed edge self-start bottom. All the components are linked and looped and meet the requirements of Statistical Note 6, Chapter 61, Harmonized Tariff Schedule of the United States (HSTUS).

The applicable subheading for the pullover will be 6110.30.3057, Harmonized Tariff Schedule of the United States (HTSUS), which provides for pullovers, knitted: of man made fibers: otherother: women’s: knit to shape articles described in statistical note 6 to this chapter. The duty rate will be 32% ad valorem.
