RE: The tariff classification of women’s knit jackets from China

Dear Ms. Whiteis:

In your letter dated February 27, 2006, you requested a classification ruling.

Two samples of women’s knit jackets were submitted and will be returned as you have requested.

Style 127211 is a jacket made of 80% cotton, 20% polyester finely knit fabric. The cut and sewn garment features long sleeves, a full front zippered opening with a zip through mock neck, front pockets and snugly fitting rib knit cuffs and waistband.

Style 128182 is a jacket made of 80% cotton, 20% polyester finely knit fabric. The cut and sewn garment features long sleeves, a full front zippered opening, a hood, front pockets and snugly fitting rib knit cuffs and waistband.

The applicable subheading for the jackets will be 6102.20.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ overcoatswindbreakers and similar articles, knitted or crocheted, other than those of heading 6104: Of cotton: Women’s. The duty rate will be 15.9% ad valorem.

The jackets fall within textile category designation 335. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
