RE: The tariff classification of a women’s knit and woven padded sleeveless jacket from China

Dear Ms. Caldwell:

In your letter dated March 1, 2006, you requested a classification ruling. A sample was submitted and is being returned as you requested.

The item in question, style 1D628, is a women’s padded sleeveless jacket with front panels made from a woven 100% nylon fabric quilted to a 5-ounce polyfill, and a back panel and hood made from a 100% acrylic knit fabric. The woven portion is lined. The garment also has a full front opening with a two-way zipper closure covered by a flap with a three-button closure and zippered, slant pockets at the waist.

As the entire front of this garment is of woven construction it is considered to have an essential character of woven fabric.

The applicable subheading for style 1D628 will be 6202.93.2020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other women’s or girls’ padded, sleeveless jackets, of man-made fibers. The duty rate will be 14.9 percent ad valorem.
