RE: The tariff classification of a child’s costume from China.

Dear Ms. Lin:

In your letter dated February 24, 2006 you requested a classification ruling.

The submitted sample, Item SW 1087, Angel Dressing with Halo Set is a child’s costume consisting of a dress, halo and wings. You state that the dress is made of knit 100% polyester fabric. However, examination revealed that the body of the dress is made of woven 100% polyester fabric with two top net knit embellishments. The dress has a woven top, net sleeves and trim and a zipper closure at the back.

The dress is well made with styling features, finished seams, neck and embellishments.

GRI 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” In this case, the dress imparts the essential character of the set.

The applicable subheading for the Angel Dressing with Halo Set will be 6204.43.3020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Women’s or girls’Dresses: Of Synthetic fibers: Other: Other, Other: Women’s." The duty rate will be 16% ad valorem. The textile category designation is 636.
