RE: The tariff classification of a ceramic candy bowl from China

Dear Mr. Stinson:

In your letter, dated January 29, 2006, you requested a tariff classification ruling regarding a ceramic candy bowl (item #944542).

A sample of the article was submitted with your ruling request. The sample will be returned to you in accordance with your request.

The bowl is approximately 3.75 inches in height. The size of the opening is approximately five inches.

You stated that the bowl will be marketed to consumers. The product is a table/kitchen article that will be used in the home to hold candies.

You stated that the candy bowl is composed of dolomite ceramics.

The applicable subheading for the ceramic (dolomite) candy bowl will be 6912.00.4810, Harmonized Tariff Schedule of the United States (HTSUS), which provides for ceramic tableware, kitchenware, other household articles and toilet articles, other than of porcelain or china: tableware and kitchenware: other: other: other: other: suitable for food or drink contact. The rate of duty will be 9.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
