RE: The tariff classification of a woman’s upper body garment from China.

Dear Mr. Chen:

In your letter dated February 21, 2006, you requested a classification ruling.

Style 3750J is a woman’s upper body garment constructed from 60 percent cotton and 40 percent acrylic knitted fabric. The short sleeve pullover has a wide and deep V-neckline that is trimmed with a ribbed-knit band. The garment bottom features a ribbed knit finish. The front of the garment provides insufficient bust coverage.

     The applicable subheading for style 3750J will be 6114.20.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, knitted or crocheted: Of Cotton: Other. The rate of duty will be 10.8% ad valorem.
