RE: The tariff classification of a costume from China.

Dear Ms. Salas Rogalski:

In your letter dated February 2, 2006, you requested a tariff classification ruling.

You submitted the following costume, which meets the flimsy, non-durable requirements and is being returned per your request:

Style 7756, Jack Sparrow Boxed Costume Set, is a textile costume set that consists of a polyester shirt, a jacket, a pirate hat and boot covers, with the jacket imparting the essential character. Although the jacket has a well-made styling feature (multiple layered belt) and a well-made closure (belts), it has flimsy construction of the neck and seams and flimsy edges at the arms, hem and closure.

The applicable subheading for style 7756, Jack Sparrow Boxed Costume Set, will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other." The rate of duty will be Free.
