RE: The tariff classification of a woman’s bolero jacket from China

Dear Mr. Yeh:

In your letter dated January 11, 2006, you requested a classification ruling.

The submitted sample, style number 4909, is a woman’s bolero jacket that is constructed from 55% silk, 45% rayon knit fabric with sequins. The garment has three panels that are sewn together lengthwise. The garment does not reach the waist. It features a round neckline, cap sleeves, and a full front opening with a hook and eye closure. The neckline, sleeves, placket and bottom are finished with ribbed fabric.

The applicable subheading for the bolero jacket will be 6104.39.2050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s suit-type jackets, knitted: of other textile materials: other: other: of silk: other. The garment has a free rate of duty.

The bolero jacket falls within textile category designation 835. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
