RE: The tariff classification of a sweatshirt from China

Dear Mr. MacMahon:

In your letter dated January 23, 2006 you requested a classification ruling.

Submitted style 399078 for Old Navy, manufactured from fleece fabric of 80% cotton/20% polyester is a pullover garment for girls’ wear that extends below the waist, further characterized by a hood, by wide, rib-knitted lower edges, and by an open pocket at each side of the lower front.

As you have requested, the sample garment is being returned.

The applicable subheading for this style will be 6110.20.2045, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweatshirtsknittedof cotton, other, other, sweatshirts, girls’. The duty rate will be 16.5 percent ad valorem.
