RE: The tariff classification of a washcloth and fingertip towel from China.

Dear Ms. Fox:

In your letter dated January 11, 2006 you requested a classification ruling on behalf of Valu-Plus, Inc.

You submitted two samples. The first sample is a washcloth made from 100 percent cotton terry fabric. All four sides of the cloth are hemmed. The washcloth measures 11 inches square. The second sample is a fingertip towel made from 100 percent cotton terry fabric. The fingertip towel measures 11 x 18 inches and all of the edges are hemmed.

The applicable subheading for the washcloth will be 6302.60.0030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bed linen, table linen, toilet linen and kitchen linen: toilet linen and kitchen linen, of terry toweling or similar terry fabrics, of cotton other. The duty rate will be 9.1 percent ad valorem.

The applicable subheading for the fingertip towel will be 6302.60.0020, HTS, which provides for bed linen, table linen, toilet linen and kitchen linen: toilet linen and kitchen linen, of terry toweling or similar terry fabrics, of cotton towels: other. The duty rate will be 9.1 percent ad valorem.

The washcloth falls within textile category designation 369. The fingertip towel falls within textile category designation 363. Textile category designation 363 from China falls within the recently announced quantitative restrictions between the United States and China, commonly referred to as China Safeguards or Safeguard Quotas. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
