RE: The tariff classification of a neck wrap from China

Dear Ms. Marcoux:

In your letter dated December 6, 2005 you requested a tariff classification ruling.

A sample and illustrative literature accompanied your letter. The sample was examined and disposed of. The “Comfort Bag”, product no. 11151, is a rectangular-shaped cotton fabric bag, measuring approximately 21 inches long and 5 inches wide, filled with flaxseed. Literature indicates the bag may be warmed in a microwave oven or cooled in a freezer, and suggests a variety of uses, ranging from reducing muscle tension to regulating body temperature.

The applicable subheading for this product will be 1404.90.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for vegetable products not elsewhere specified or includedother. The rate of duty will be free.
