RE: The tariff classification of a woman’s upper body garment from China.

Dear Ms. Bauman:

In your letter dated December 1, 2005, you requested a classification ruling on behalf of Maurices Inc. As requested, your sample will be returned.

Style MK06332 is a woman’s upper body garment constructed from 50 percent nylon, 40 percent cotton and ten percent spandex knit openwork fabric. The garment has a full front opening, short sleeves, and satin fabric finishing the bottom, extending approximately 20 inches on each side, forming ties. The garment does not reach the waist, and does not provide sufficient coverage of the bust.

The applicable subheading for style MK06332 will be 6114.30.3070, Harmonized Tariff Schedule of the United States (HTS), which provides for Other garments, knitted or crocheted: Of man-made fibers: Other: women’s or girls’. The duty rate will be 14.9% ad valorem.
