Dear Ms. Bauman:

In your letter dated December 1, 2005, you requested a classification ruling on behalf of Maurices Inc. As requested, your sample will be returned.

The garment has a full front opening, short sleeves, and satin fabric finishing the bottom, extending approximately 20 inches on each side, forming ties. The garment does not reach the waist, and does not provide sufficient coverage of the bust.

The applicable subheading for style MK06332 will be 6114.30.3070, Harmonized Tariff Schedule of the United States (HTS), which provides for Other garments, knitted or crocheted: Of man-made fibers: Other: women’s or girls’. The duty rate will be 14.9% ad valorem.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

Style MK06332 falls within textile category designation 659. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
