RE: The tariff classification of Allyl-t-butylcarbonate, CAS # 70122-89-3, imported in bulk form, from China

Dear Mr. Chivini:

In your letter dated November 30, 2005 you requested a tariff classification ruling.

The subject product, Allyl-t-butylcarbonate, is an ester of an inorganic acid (carbonic acid) indicated for use as a pharmaceutical intermediate.

The applicable subheading for Allyl-t-butylcabonate, also known as 1,1-Dimethyl-2-propenyl ester, will be 2920.90.5090, Harmonized Tariff Schedule of the United States (HTS), which provides for Esters of other inorganic acids of nonmentals (excluding esters of hydrogen halides) and their salts; their halogenated, sulfonated, nitrated or nitrosated derivatives: Other: Other: Other. The rate of duty will be 3.7 percent ad valorem.
