RE: The tariff classification of a woman’s garment from Hong Kong.

Dear Ms. Fox:

In your letter dated November 18, 2005, you requested a classification ruling for a woman’s knit garment from Hong Kong on behalf of Jones Apparel Group. The submitted sample will be returned to you, as requested.

Style WFHH33688 is a woman’s knit upper body garment constructed from 51 percent acrylic and 49 percent nylon knit fabric. The garment reaches the waist only in the back and has a full front opening and short sleeves. The neckline, front opening and bottom are finished with a crocheted panel. The front of the garment does not provide coverage of the bust area.

The applicable subheading for style WFHH33688 will be 6114.30.3070, Harmonized Tariff Schedule of the United States (HTS), which provides for Other garments, knitted or crocheted: Of man-made fibers: Other: Women’s or girls’. The duty rate will be 14.9% ad valorem.
