RE: Tariff classification of 3-dimensional figure-shaped wax novelty candles from China.

Dear Ms. Man-Shoong:

In your letter dated December 2, 2005 you requested a tariff classification ruling on 3-dimensional figure-shaped wax novelty candles.

Item# R6189 and R6190 Star Candle with Ivory Beads (4”H x 6”D) consist of a 3-dimensional star-shaped wax candle retail packed in a clear polybag tied with raffia. The candles are said to contain 60% palm oil.

Item# R6191 and R6192 Star Candle with Ivory Beads (4”H x 4”D) consist of a 3-dimensional star-shaped wax candle retail packed in a clear polybag tied with raffia. The candles are said to contain 60% palm oil.

Item# R6193 and R6194 Star Candle with Ivory Beads (3.25”H x 4”D) consist of a 3-dimensional star-shaped wax candle retail packed in a clear polybag tied with raffia. The candles are said to contain 60% palm oil.

Item# R6236 White Glitter Snowball Candles set (2”D) consists of six white 3-dimensional snowball-shaped wax candles retail packed in a clear PVC tube with printed snowflakes. The candles are said to contain 60% palm oil.

Item# R6270, R6271 and R6272 Tree / Star / Angel Candles sets (2.25”H x 1.5”D) consist of five 3-dimensional tree- / star- / angel-shaped wax candles retail packed in a clear PVC box. The candles are said to contain 60% palm oil.

The applicable subheading for the 3-dimensional figure-shaped wax novelty candles individually packed or in sets, will be 3406.00.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for candles, tapers and the like. The rate of duty will be free.

Candles from China may be subject to anti-dumping duties administered by the U.S. Department of Commerce, Import Administration.
