RE: The tariff classification of a fan hub

Dear Mr. Forhart:

In your letter dated October 10,2005 you requested a tariff classification ruling on behalf of your client Freightliner LLC. Descriptive information and a technical drawing were submitted.

The article in question is described as a fan hub, part number KYS1077 07895 04, which is part of an engine cooling fan assembly. You indicate that the fan hub consists of four main components: a mounting back plate, a spindle shaft, roller bearings, and a drive pulley that also serves as a mount for the engine cooling fan blade and the fan clutch. You aver that the fan hub is classifiable in heading 8414, Harmonized Tariff Schedule of the United States (HTSUS), which provides for parts of fans. You offer New York ruling K87837 in support of your position.

We agree that the fan hub is, prima facie, a part of a cooling fan assembly, however, based on the information provided we find that the fan hub is more specifically provided for as a mounted pulley in HTSUS heading 8483. The cooling fan mounting assembly considered in New York ruling K87837 was classified in HTSUS heading 8414, as a part of the cooling fan, because it was not more specifically provided elsewhere in the tariff.

The applicable subheading for the fan hub will be 8483.50.9040, HTSUS, which provides for grooved pulleys. The general rate of duty will be 2.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
