RE: The tariff classification of plush toy phone accessories from China

Dear Mr. Crago:

In your letter dated December 6, 2005, you requested a tariff classification ruling.

You are requesting the tariff classification on a product that is described as a plush phone accessory, item #’s C080JA02558 and C080JA02559. The plush toy miniature animals are designed as phone charms for the amusement of children or adults, while using a cell phone. The proper classification of the toy phone charms will be as stuffed toys representing animals. The samples will be returned, as requested by your office.

The applicable subheading for the plush toy phone accessories, item #’s: C080JA02558 and C080JA02559, will be 9503.41.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for toys representing animals or non-human creaturesand parts and accessories thereof: stuffed toys and parts and accessories thereof. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
