RE: The tariff classification of a woman’s pajama bottom from India

Dear Ms. Greener:

In your letter dated October 21, 2005, you requested a classification ruling. The submitted sample will be returned to you as requested.

Item number 057-0665 is a woman’s pajama bottom constructed from 100 percent cotton woven fabric. The garment features an elasticized drawstring waist and capri length legs.

You have indicated that this garment is a mix and match item that will be merchandised with nightgowns and robes and will be sold in the sleepwear department. Based on appearance, as well as the supporting marketing information provided, the garments will be classified as sleepwear in heading 6208, HTS

The applicable subheading for item number 057-0665 will be 6208.91.3010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ singlets and other undershirts, slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles: other: of cotton: other: women’s. The duty rate will be 11.2 percent ad valorem.

Item number 057-0665 falls within textile category designation 352. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
