RE: The tariff classification of a woman’s cardigan and pullover from Hong Kong

Dear Ms. Purcell:

In your letter dated October 13, 2005, you requested a tariff classification ruling. Your samples are being returned as requested.

The submitted sample, style number A69749, is comprised of a woman’s cardigan and pullover. The garments are constructed from 95% cotton, 5% spandex, knit fabric. The outer surface of both garments measures more than 9 stitches per 2 centimeters in the horizontal direction.

The cardigan features a ribbed mock collar, long sleeves with loose-fitting ribbed cuffs, a full front opening with a zipper closure, and a loose-fitting ribbed bottom. Horizontal overlaid strips are sewn on the front chest.

The pullover is piece constructed and features a ribbed V-neckline, short hemmed sleeves, and a hemmed bottom

The applicable subheading for the cardigan and the pullover will be 6110.20.2075 Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pulloversand similar articles, knitted: of cotton: otherother: women’s. The rate of duty will be 16.5% ad valorem.

The cardigan and the pullover fall within textile category designation 339. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
