RE: The tariff classification of women’s pajamas from Macau.

Dear Ms. De Silva:

In your letter dated September 28, 2005, you requested a classification ruling for women’s pajamas from Macau. The sample will be returned, as requested.

The submitted sample, style 293797, is a pair of women’s pajamas constructed from 95 percent cotton, five-percent spandex knit fabric. The tank top styled pajama top has 1-1/2 inch shoulder straps, a V neckline in front, U neckline in back, and a plain, hemmed bottom. The neckline, shoulder straps, armholes, and bottom are finished with ¼ inch capping. The shorts styled pajama bottom has an elasticized waistband, and matching capping finishing the leg openings.

The applicable subheading for style 293797 will be 6108.31.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for women's knit ...nightdresses of cotton. The rate of duty will be 8.5 percent ad valorem.
