RE: The tariff classification of a wine bottle bag from India.

Dear Mr. Saha:

In your letter dated September 23, 2005, you requested a classification ruling for a wine bottle bag.

The sample submitted is identified as item BRD-04. The item is a carrying bag sized to contain a wine bottle and measures approximately 15”(H) x 5 ½”(W) x 4”(D). It is manufactured with an exterior surface of 100% jute textile material with double carrying handles and an unsecured top opening. You have stated that although the sample submitted features two braided rope-like carrying straps, the sample being imported will be identical except that the carrying handles will be of (cane) wood.

The applicable subheading for the wine bottle bag will be 4202.92.9036, Harmonized Tariff Schedule of the United States (HTS), which provides in part, for other bags and containers, with outer of textile materials, other, other. The duty rate will be 17.6 percent ad valorem.

HTS 4202.92.9036 falls within textile category designation 870. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
