RE: The tariff classification of women’s knit shirts and a cardigan from China, Singapore and Hong Kong.

Dear Ms. Girvin:

In your letter dated August 17, 2005, you requested a tariff classification ruling for three women’s shirts.

The submitted samples are described as follows:

Style #009-9991 – A woman’s shirt constructed from 100% cotton knit fabric. The garment features a hood, long sleeves, a deep front V-neck opening with a tie closure, slits at both sides, and a hemmed bottom. The fabric of the shirt has more than 10 stitches per centimeter counted in both the horizontal and vertical directions.

Style #009-9993 – A woman’s shirt constructed from 100% cotton knit fabric. The garment features a hood, long sleeves, a deep front V-neck opening with a one-button closure, and a tubular bottom. The fabric of the shirt has more than 10 stitches per centimeter counted in both the horizontal and vertical directions.

A woman’s cardigan imported under Styles 009-9670 (regular size), 009-9671 (petite size), and 009-9672 (tall size). The garment is constructed from 77.5% cotton and 22.5% spandex waffle weave knit fabric. The shirt features a hood, a full front opening with a zipper closure, pockets at the waist, and a wide rib knit bottom. The fabric of the garment has more than 9 stitches per two centimeters measured in the direction the stitches were created.

The applicable subheading for the shirts, Styles 009-9991, and 009-9993, will be 6106.10.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ blouses and shirts, knitted or crocheted, of cotton, women’s. The rate of duty will be 19.7% ad valorem.

The applicable subheading for the cardigan, 009-9670 (regular size), 009-9671 (petite size), and 009-9672 (tall size), will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for pullovers, of cotton, other, other, women’s. The rate of duty will be 16.5% ad valorem.

Styles 009-9991, 009-9993, 009-9670 (regular size), 009-9671 (petite size), and 009-9672 (tall size) fall within textile category designation 339. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
