RE: The tariff classification of men’s knit lounge pants from Honduras.

Dear Mr. Venable:

In your letter dated August 26, 2005, you requested a tariff classification ruling. As requested, your sample will be returned.

Style R655 is a pair of men’s lounge pants constructed from 100 percent polyester, finely knit fabric. The pants have a tunnel elastic waistband with an outside drawstring; a contrasting color, self-fabric, narrow overlaid stripe on each side seam; a left rear patch pocket; an embroidered logo on the left hip; and hemmed legs.

Although you identify the garment as a sleep pant, garments of this style and construction are considered multi-use garments for wear in a variety of situations in and around the home. As such, they are not classified as sleepwear, which is limited to garments that are designed for wear only to bed for sleeping.

Consequently, the applicable subheading for Style R655 will be 6103.43.1520, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s and boys’ trousers, breeches and shorts (other than swimwear), knitted or crocheted: of synthetic fibers: trousers and breeches men’s. The rate of duty is 28.2 percent ad valorem.

Style R655 falls within textile category designation 647. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
