RE: The tariff classification of a woman’s bustier from China

Dear Mr. Zelman:

In your letter dated August 1, 2005, you requested a tariff classification ruling on behalf of Elie Tahari, Ltd. The submitted sample will be returned to you as requested.

Style E10G6506 is a woman’s bustier constructed from 100 percent silk woven fabric. The garment features adjustable spaghetti straps, bra cups, a lining and a full back opening secured by fourteen hook and eye closures. The garment also has support strips, embroidery and rhinestone trim and a decorative knit trim at the bottom.

The applicable subheading for style E10G6506 will be 6211.49.1090, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of other textile materials: containing 70 percent or more by weight of silk or silk waste: other. The duty rate will be 1.2 percent ad valorem.
