RE: The tariff classification of three women’s pullovers from various countries

Dear Ms. Whitley:

In your letter dated July 20, 2005, you requested a tariff classification ruling. Your samples are being returned as requested.

You submitted three samples of women’s knit pullovers. The outer surface of the pullovers measures more than 9 stitches per 2 centimeters in the horizontal direction.

Style number H2902S6 is constructed from 60% cotton, 40% cotton, double-knit fabric. The garment features a round scallop neckline, short sleeves with a scallop finish, and a hemmed bottom. The country of origin is Lesotho.

Style number F3740S6 is constructed from 100% cotton, rib knit fabric. The garment features a crew neckline, short hemmed sleeves, and a hemmed bottom. An embroidered floral design with beads is on the front in the chest area. The country of origin is India.

Style number H2715S6 is constructed from 60% cotton, 40% polyester, double-knit fabric. The garment features a double ribbed neckline, shoulder pads, side slits, and a hemmed bottom. The country of origin is Lesotho.

The applicable subheading for each of the three pullovers will be 6110.20.2075, Tariff Schedule of the United States (HTS), which provides for pullovers, knitted: of cotton: otherother: women’s. The rate of duty will be 16.5% ad valorem.

Each of the three pullovers falls within textile category designation 339. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
