RE: The tariff classification of a bag from China

Dear Ms. Schachner:

In your letter dated June 30, 2005, received via fax, you requested a tariff classification ruling.

The submitted sample is a bag that measures approximately 24” x 39” and weighs 1.135 kilograms. It is constructed of 100 percent woven uncoated polypropylene strips. The strips meet the dimensional requirements of man-made fiber textile strips contained in Section XI, Legal Note 1(g) of the Harmonized Tariff Schedule of the United States (HTS). The bag is open on one end and is sewn shut on the other end.

The applicable subheading for the bag will be 6305.33.0010, HTS, which provides for sacks and bags of a kind used for the packing of goods: Of man-made textile materials: Other, of polyethylene strip or the like, weighing one kilogram or more. The rate of duty will be 8.4 percent ad valorem.

HTS 6305.33.0010 falls within textile category designation 669. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” available at our web site at www.cbp.gov. In addition, you will find current information on textile import quotas, textile safeguard actions and related issues at the web site of the Office of Textiles and Apparel, at www.otexa.ita.doc.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Mitchel Bayer at 646-733-3102.
