RE: The tariff classification of a decorative candleholder set from China.

Dear Ms. Tymejczyk:

In your letter dated June 21, 2005, on behalf of M. Fortunoff of Westbury, you requested a tariff classification ruling. Sample is being returned as requested.

The submitted sample is a candleholder set, style number C525257, that consists of a cylindrical-shaped frosted-glass candleholder, measuring approximately 2 ½ inches in height by 2 inches in diameter, with a cylindrical candle. It also has a candle ring that is principally composed of feathers as well as artificial beads. It is noted that this merchandise will be imported in a condition suitable for sale directly to users without repacking.

The applicable subheading for this decorative candleholder set will be 9405.50.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other non-electrical lamps and lighting fittings, other. The rate of duty will be 6 percent ad valorem.

The candle in this set may be subject to antidumping duties or countervailing duties.
