RE: The tariff classification of men’s knit pullover garments from Thailand and China.

Dear Ms. Allen:

In your letter received by the U.S. Customs Service on June 13, 2005, you requested a tariff classification ruling. As requested, your samples will be returned.

Style B4064-069 is a men’s pullover garment constructed from 55 percent silk, 45 percent cashmere, jersey knit fabric that measures 12 stitches per two centimeters counted in the horizontal direction. Style B4064-069 features a rib knit V-neckline; long sleeves with rib knit cuffs; and a rib knit bottom.

Style B4065-089 is a men’s pullover garment constructed from 55 percent silk, 45 percent cashmere, knit fabric that measures 12 stitches per two centimeters counted in the horizontal direction. Style B4065-089 has an intarsia knit front panel and features a rib knit crew neckline; long sleeves with rib knit cuffs; and a rib knit bottom.

The applicable subheading for Styles B4064-069 and B4065-089 will be 6110.90.9072, Harmonized Tariff Schedule of the United States, (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of other textiles materials: other: other: other: subject to wool restraints: men's or boys'. The rate of duty is 6 percent ad valorem.

Styles B4064-069 and B4065-089 fall within textile category designation 438. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
