RE: The tariff classification of scaffolding rollers from China.

Dear Mrs. Spurgeon:

In your letter dated May 12, 2005, on behalf of your client Granite Industries Inc., you requested a tariff classification ruling. Included with your letter were samples of two types of scaffolding rollers. Your samples are being returned as requested.

The items to be imported are scaffolding rollers. One roller is manufactured with a steel shaft and plastic wheel and plastic hub. The other roller is manufactured with a steel shaft, steel hub and rubber wheel. The rollers will be imported both alone and also with the complete unassembled steel scaffolding.

The applicable subheading for both rollers when imported with the scaffolding and for the roller with the steel hub when imported alone will be 7308.40.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for structures (excluding prefabricated buildings of heading 9406) and parts of structures (for example, bridges and bridge sections, lock gates, towers, lattice masts, roofs, roofing frameworks, doors and window and their frames and threshold for doors, shutters, balustrades, pillars and columns) of iron or steel; plates rods, angles, shapes sections, tubes and the like , prepared for use in structures, of iron or steel, equipment for scaffolding, shuttering, propping or pit propping. The rate of duty will be free.

The applicable subheading for the roller with plastic wheel and plastic hub will be 3926.90.9880, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of plastics and articles of other materials of headings 3901 to 3914, other, other, other. The rate of duty will be 5.3%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
