RE: The tariff classification of a tinsel cord from China

Dear Ms. Ursery:

In your letter dated May 11, 2005, you requested a tariff classification ruling.

The submitted sample is identified as Item #QX01310 Green and Red Tinsel Cord. You indicate that the item is of knit construction and is made of 90 percent metallic strips and 10 percent polyester. It is not twisted, cabled, or gimped. The polyester yarns are knit and the metallic strips, each less than one millimeter in width, are inserted into the stitches, creating a chenille effect. The strips meet the dimensional requirements of man-made fiber textile strips contained in Section XI, Legal Note 1(g) of the Harmonized Tariff Schedule of the United States (HTS). A wire is inserted to allow the yarn to be shaped.

The applicable subheading for the tinsel cord will be 5606.00.0090, HTS, which provides for chenille yarn. The rate of duty will be 8 percent ad valorem.

Merchandise classified in subheading 5606.00.0090, HTS, falls within textile category designation 201. Based upon international textile trade agreements, products of China are subject to quota and the requirement of a visa. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” available at our web site at www.cbp.gov. In addition, you will find current information on textile import quotas, textile safeguard actions and related issues at the web site of the Office of Textiles and Apparel, at www.otexa.ita.doc.gov.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Mitchel Bayer at 646-733-3102.
