RE: The tariff classification of decorative electric table lamps from Hong Kong.

Dear Mr. Rodriguez:

In your letter dated April 12, 2005, you requested a tariff classification ruling.

The subject merchandise, based on the submitted information, is decorative electric household table lamps, item numbers 81057, 81058, 81059, 81060 and 81061, which are stated to measure 12 ¾ inches in height. Each lamp consists of a ceramic body, measuring about 6 ¼ inches in diameter, with a shade composed of cardboard, as well as a lamp-holder and a harp composed of metal. All of these lamps are fitted with a power cord.

The applicable subheading for these electric household table lamps will be 9405.20.8010, Harmonized Tariff Schedule of the United States (HTS), which provides for Lamps and lighting fittingsnot elsewhere specified or includedElectric table, desk, beside or floor-standing lamps: Other than of base metal, Household. The rate of duty will be 3.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
