RE: The tariff classification of a women’s jacket from an undetermined country

Dear Ms. Bailey:

In your letter dated February 22, 2005, you requested a classification ruling. A sample was submitted and is being returned as you requested.

The item in question, style 1506, is a juniors’ jacket made from a 100% cotton woven fabric. It has a full front opening secured by a two-way metal zipper, patch pockets with buttoned flaps at the waist and in the chest, long sleeves with one-button vented cuffs, side vents, adjustable back tabs and a removable imitation fur collar. Each of the buttons on the pockets, cuffs and tabs features the logo, “Canyon River Blues.”

The applicable subheading for the jacket will be 6202.92.2061, Harmonized Tariff Schedule of the United States (HTS), which provides for other women’s anoraks (including ski-jackets), windbreakers and similar articles, of cotton. The duty rate will be 8.9 percent ad valorem.

This jacket falls within textile category designation 335. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
