RE: The tariff classification of printed paper gift tags from China.

Dear Ms. Freese:

In your letter dated February 4, 2005, you requested a tariff classification ruling.

A sample identified as item #923049 was submitted for our examination. It is a retail packet of nine folded paper gift tags (six square and three round), each measuring about two inches in diameter in closed condition. The face of each tag is lithographically printed with a picture (of Santa Claus or a snowman) accented with an affixed star-shaped plastic “jewel.” The interior and back surfaces are blank, suitable for entering to/from gift information. A short length of red string, which will facilitate attachment to a wrapped gift package, has been tied onto each tag through a small hole near the top edge.

The applicable subheading for the #923049 tags will be 4821.10.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for paper and paperboard labels printed in whole or in part by a lithographic process. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
