RE: The tariff classification of a dishcloths from Pakistan.

Dear Ms. Milling:

In your letter dated you requested a classification ruling.

You will be importing item number 218098, a package of 25 dishcloths. The cloths will be made from 100 percent cotton woven terry fabric. They will measure 11 inches square and feature rounded corners. The edges of the cloths are finished with an overlock stitch. In your letter you indicate that the 25 dishcloths will be packaged with an outer wrapper that states Dish Cloth. The cloths will be advertised and sold in the home décor/kitchenware department.

In your letter you suggest that the instant cloth should be classified under subheading 6302.60.0020, HTS as bath and kitchen linen. That subheading covers “other terry towels”. The dishcloths are a cleaning cloth and specifically provided for under subheading 6307.10.2027, HTS.

The applicable subheading for the dishcloths will be 6307.10.2027, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles, including dress patterns: floorcloths, dishcloths, dusters and similar cleaning cloths: dustcloths, mop cloths and polishing cloths: other dish cloths: of cotton. The duty rate will be 5.3 percent ad valorem.

The dishcloths fall within textile category designation 369. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” available at our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
