RE: The tariff classification of an “Infant Play Tube” from an unknown country.

Dear Mr. Fladager:

In your letter dated November 15, 2004, and received December 21, 2004, you requested a tariff classification ruling.

You submitted a photograph and product information regarding an “Infant Play Tube” identified as item number SKN 402419. The item is a round inflatable polypropylene tube that measures approximately 36” in diameter with a soft polyester and cotton cloth covering. The covering depicts printed color images of a bunny, a teddy bear, a dog, etc. The item is designed as a portable play environment for an infant 3-12 months of age who will be placed inside the tube. Once inside, the infant will be drawn to the brightly colored tube covering and derive visual and manual stimulation from touching and squeezing the colorful printed animals.

The applicable subheading for the “Infant Play Tube” identified as item number SKN 402419 will be 9503.90.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for "Other toys; reduced-size ("scale") models and similar recreational models, working or not; puzzles of all kinds; parts and accessories thereof: Other: Other." The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
