RE: The tariff classification of hat and glove sets from Taiwan.

Dear Mr. Ashear:

In your letter dated June 8, 2004 you requested a classification ruling. The samples will be returned to you as requested.

The submitted samples are hat and glove sets that will be put up for retail sale. Style 8432002 is watch cap style and composed of knit acrylic fabric. The hat has a turned cuff with a sequin heart design. The gloves are composed of knit 95% acrylic/4% polyester/1% spandex fabric. The gloves are full fingered, without fourchettes and feature a knit cuff and sequin applique.

Style 8342004 is watch cap style and composed of knit 89% acrylic/10% polyester/1% spandex fabric. The hat has a turned cuff with a sequin applique. The gloves are full fingered, without fourchettes and features a rib knit cuff and embroidered applique.

GRI 3(c) states: When goods cannot be classified by reference to 3(a) or 3(b), they shall be classified under the heading which occurs last in numerical order among those which equally merit consideration.

The applicable subheading for the hat and glove sets, styles 8432002 and 8342004 will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTS), which provides for "Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hair-nets of any material, whether or not lined or trimmed: Other: Of man-made fibers: Not in part of braid, Other: Other." The duty rate will be 20 cents/kg + 7% ad valorem. The textile category designation is 659.

Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
