RE: The tariff classification of the Grafton Entertainment Unit from China.

Dear Mr. Derian:

In your letter dated July 29, 2004, you requested a tariff classification ruling.

The merchandise to be imported is identified as the Grafton Entertainment Unit, No. 22-070-1. The item is made of wood and is inspired by 18th century Irish architecture. It features a cabinet which can conceal televisions up to 36 inches in size and a bottom unit with one shelf.

The applicable subheading for the Grafton Entertainment Unit will be 9403.50.9080, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other furniture and parts thereof: Wooden furniture of a kind used in the bedroom: Other: Other, Other.” The rate of duty will be free.

The merchandise in question may be subject to antidumping duties or countervailing duties. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
