RE: The tariff classification of a Textile Costumes from China

Dear Ms. Cameron:

In your letter dated November 19, 2004 you requested a tariff classification ruling.

The first costume, item number 51005 – Karate Gi, consists of a jacket and a pair or pants. The jacket is made of a thin woven material in the traditional Gi style. All the edges have visible overlock stitching, except the two-layer collar, which has a raw edge. The jacket meets the flimsy and non-durable requirements for classification within Heading 9505.is the essential character of the costume.

We have not ruled on the second costume, item number 35113 – Princess Tutu, as you have informed us it will be changed. Your samples are returned as requested.

The applicable subheading for Item 51005 – Karate Gi will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for Festive, carnival or other entertainment articles, including magic tricks, and practical joke articles; parts and accessories thereof: Other: Other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
