RE: The tariff classification of sales displays from the U.K..

Dear Mr. Antoniades:

In your letter dated October 21, 2004, you requested a ruling on tariff classification.

The merchandise is a number of metal point-of-sale displays, an acrylic display and a sugar shaker. The metal displays hold key holders, coasters and photo hooks (not the subjects of this ruling). We assume that they are all made of steel. The Shake-me Sugar Shaker is made of food grade PVC, is 150mm high and 80mm in diameter. The acrylic display is for the Squeeze-me Lemon Squeezer.

The applicable subheading for the metal point-of-sale displays will be 7326.90.8587, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of iron or steel, other. The general rate of duty will be 2.9 percent ad valorem.

The applicable subheading for the PVC sugar shaker will be 3924.10.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for tableware, kitchenware, other household articlesof plastics: tableware and kitchenware: other. The rate of duty will be 3.4 percent ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on the acrylic display. Your request for a classification ruling should include a sample. Also, is the display case designed to allow the photo to be changed? When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.).
