RE: The tariff classification of a vanity case from China.

Dear Ms Kwok:

In your letter dated October 8, 2004, you requested a classification ruling for a vanity case.

The sample submitted is identified as “Grey Nylon Box”, CKC1005-600. The item appears to be an unfinished vanity case designed to provide storage, protection, organization and portability for personal effects. It is manufactured with an exterior surface of 100% nylon man-made fiber textile material. The top lid has a clear plastic window and the interior is lined with textile materials. It measures approximately 7”(W) x 3”(H) x 6 ¼”(D).

The applicable subheading for item CKC1005-600 will be 4202.12.8070, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases, vanity cases and similar containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.8 percent ad valorem.

HTS 4202.12.8070 falls within textile category designation 670. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa.

You have asked whether this product is subject to antidumping duties or countervailing duties. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
