RE: The tariff classification of Games from China

Dear Mr. Thompson:

In your letter dated April 19, 2004, on behalf of G. A. Gertmenian & Sons of Los Angeles, California, you requested a tariff classification ruling.

You submitted descriptive literature and product samples with your request. The subject merchandise is two different style “Jumbo Fun Game Rugs”. The first item, Style 16511, is a 40-inch by 58-inch nylon pile game rug with 27 oversize checker game pieces, plus game instructions and a plastic carrying case. The second product, Style 16512, is a 30-inch by 74-inch nylon pile game rug, 4 beanbag hopscotch markers, plus game instructions and a plastic carrying case.

The applicable subheading for the “Jumbo Fun Game Rugs” will be 9504.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for Articles for arcade, table or parlor gamesparts and accessories thereof: Other: Chess, checkers, parchisi, backgammon, darts and other games played on boards of a special design, all the foregoing games and parts thereof (including their boards)packaged together as a unit in immediate containers of a type used in retail sales. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
